Terms of Service

These Terms of Service ("Terms") govern your use of house36marketing.com (the "Site") and any website-build service you purchase from House36 Marketing ("House36," "we," "us," or "our"). By using the Site or purchasing our service, you agree to these Terms.

1. The service

House36 designs and builds a custom five-page website for local and small businesses ("the Build"), including authority copywriting, mobile-first responsive design, on-page SEO and schema markup, AI-search-ready architecture, and standard analytics/CRM/form integrations, as described on the Site. The Build is a fixed-scope product; work beyond the described scope may require a separate agreement.

2. Onboarding & the 72-hour timeline

The Build begins, and the 72-hour delivery clock starts, when you submit a complete intake form with all information and materials we reasonably require. Delays caused by incomplete information, slow responses, or missing access pause the clock until the needed items are provided.

3. On-time guarantee

If your site is not live within 72 hours of a complete intake submission, the Build is free, subject to this section. The guarantee does not apply to delays caused by you or third parties (for example, incomplete intake, late approvals, domain or hosting access issues, or outages outside our control).

4. Revisions

Every Build includes a 14-day "love it" revision period and 30 days of post-launch done-for-you tweaks (copy edits, image swaps, minor layout changes) as described on the Site. Revisions are limited to the original scope; new pages or new functionality are out of scope.

5. Pricing & payment

Pricing is shown on the Site and is due as indicated at checkout. Payments are processed by Stripe. You agree to provide accurate billing information and authorize us to charge the applicable fees.

6. Refunds

Because the Build is a custom, made-to-order service, fees are generally non-refundable once work has begun, except where the on-time guarantee in Section 3 applies or as required by law. If you are unsatisfied, we will work with you under the revision terms in Section 4.

7. Your responsibilities

• Provide accurate, complete, and lawful information and materials.
• Confirm you have the rights to any content, logos, or images you supply.
• Respond promptly to requests for approvals or clarification.
• Use the Site and the delivered website in compliance with applicable laws.

8. Ownership & intellectual property

Upon full payment, you own the final delivered website and its custom content. We retain ownership of our underlying tools, templates, frameworks, and know-how, and may showcase non-confidential aspects of completed work in our portfolio unless you request otherwise in writing. Content you provide remains yours; you grant us a license to use it to perform the service.

9. Third-party services

The delivered website and our Site may rely on third-party services (e.g., hosting, analytics, payment, and form providers). Your use of those services may be subject to their own terms, and we are not responsible for third-party services we do not control.

10. Disclaimers

We build sites with SEO and AI-search-ready architecture, but we do not guarantee specific rankings, traffic, leads, or revenue, which depend on factors outside our control. The service and Site are provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law.

11. Limitation of liability

To the fullest extent permitted by law, House36 will not be liable for any indirect, incidental, special, or consequential damages, and our total liability for any claim relating to the service will not exceed the amount you paid us for the Build giving rise to the claim.

12. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in California, and you consent to their jurisdiction.

13. Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted, and we will update the "Last updated" date above. Continued use of the Site or service after changes constitutes acceptance.
